2. General Terms and Conditions of use for the site and the services available.

Use of www.becomtech.fr implies the full acceptance of the general terms and conditions of use set out below. These terms and conditions of use may be modified or supplemented at any time, therefore users of www.becomtech.fr are encouraged to consult them on a regular basis.

This site is normally accessible to users at all times. However BECOMTECH may decide to interrupt the service to carry out technical maintenance. In this case, it will endeavor to give users advance notice of the dates and times of the work.

 

The site www.becomtech.fr is updated regularly by the Communications Manager. Likewise, the legal notices may be modified at any time: however the user is bound by these notices and encouraged to read and take note of them as often as possible.

3. Description of the services on offer

The site www.becomtech.fr is intended to provide information on all of the company’s activities.

BECOMTECH will endeavor to provide the most precise information possible on www.becomtech.fr. However, it may not be held liable for omissions, inaccuracies or deficiencies in terms of updates, whether of its own doing or that of the third-party partners who supply it with this information.

All the information indicated on www.becomtech.fr is provided as guidance and liable to change. Furthermore, the information on www.becomtech.fr is not exhaustive. It is subject to changes implemented following its publication online.

4. Contractual limitations on technical data.

The site uses JavaScript technology.

The website may not be held liable for material damage linked to the use of the site. Furthermore, the site user pledges to access the site using relatively new equipment free of viruses and with an up-to-date, latest-generation browser.

5. Intellectual property and infringement.

The BECOMTECH association owns the intellectual property rights or holds the usage rights for all accessible components on the site, namely text, images, graphics, logos, icons, sounds and software.

Any reproduction, representation, modification, publication or adaptation of all or part of the site components, regardless of the method or process used, is forbidden, except in the case of prior written permission from BECOMTECH.

Any unauthorized use of the site or any of the site components will be regarded as an infringement and subject to legal proceedings in accordance with the provisions of articles L.335-2 et. seq. of the French Intellectual Property Code.

6. Limitations on liability

BECOMTECH may not be held liable for direct or indirect damage caused to the user’s equipment while accessing www.becomtech.fr, caused by either the use of equipment not meeting the specifications set out in point 4 or the presence of a bug or compatibility issue.

Likewise, BECOMTECH may not be held liable for indirect damage (such as lost business or a lost opportunity) after using www.becomtech.fr.

Interactive spaces (with the option to ask questions in the contact space) are available for users to access. BECOMTECH reserves the right to delete, without prior notice, any content added to this space in breach of the legislation applicable in France, particularly data protection provisions.  Where necessary, BECOMTECH also reserves the right to invoke the user’s civil and/or criminal liability, particularly in the event of a racist, abusive, defamatory or pornographic message, regardless of the medium used (text, photography, etc.).

7. Personal data management.

In France, personal data is protected by law no. 78-87 of January 6, 1978, law no. 2004-801 of August 6, 2004, article L. 226-13 of the French Penal Code and the European Directive of October 24, 1995.

When using www.becomtech.fr, the following data may be collected: the URL of links through which the user has accessed the site www.becomtech.fr, the user’s service provider and the user’s Internet Protocol (IP) address.

In any event, BECOMTECH only collects the user’s personal data for the purposes of certain services offered by www.becomtech.fr. The user knowingly provides this information, namely when entering it themselves. At this point, the www.becomtech.fr user is advised as to whether this information is required.

In accordance with the provisions of articles 38 et seq. of law 78-17 of January 6, 1978 on data processing, data files and individual liberties, any user has the right to access, rectify and oppose their personal data by making a signed, written request, accompanied by a copy of their identity card with the signature of the identity card holder, specifying the address to which the response must be sent.

None of the user’s personal data from www.becomtech.fr is published unbeknown to the user, exchanged, transferred, assigned or sold on any medium to third parties. Only in the event that BECOMTECH and its rights are sold would said information be transferred to the potential buyer who, in turn, would be bound by the same obligation to the
 www.becomtech.fr user in terms of the storage and modification of the data.

The databases are protected by the provisions of the law of July 1, 1998, transposing directive 96/9 of March 11, 1996 on the legal protection of databases.

The site www.becomtech.fr contains a number of hyperlinks to other sites, added with the authorization of BECOMTECH. However, BECOMTECH is unable to check the content of thus visited sites and will therefore assume no liability in this regard.

9. Applicable law and attribution of jurisdiction.

Any dispute relating to the use of www.becomtech.fr is governed by French law. It will come under the exclusive jurisdiction of the relevant Paris courts.
